Bipartisan Energy Bills in Pennsylvania Await Court Decision on RGGI

HARRISBURG — A new set of energy legislation aimed at enhancing electricity production and regulating clean energy is garnering rare bipartisan support within Pennsylvania’s split legislature. However, Senate Majority Leader Joe Pittman (R., Indiana) indicated that discussions on these bills will remain stalled until the state Supreme Court issues a final ruling on the Regional Greenhouse Gas Initiative (RGGI).

The RGGI, which was adopted by the previous Democratic administration in 2019 as a climate action strategy, has faced ongoing legal challenges. The court’s upcoming decision is pivotal, as it will influence the direction of energy production policies in the state. Pittman emphasized that legislative efforts would be unproductive until the implications of the ruling on RGGI are clearer.

Supporters of RGGI argue it will significantly reduce harmful carbon emissions while minimally impacting energy costs. In contrast, opponents fear it may deter energy companies from operating in Pennsylvania, ultimately raising costs for consumers.

In parallel, bipartisan efforts are underway to revamp the EDGE tax credit program, a $2.6 billion initiative that has yet to see implementation. Governor Josh Shapiro’s proposal to simplify access to these credits has gained traction. A recent House-passed amendment lowers investment thresholds and focuses incentives on clean energy initiatives.

Despite lingering concerns about RGGI, other bipartisan measures, such as a proposal for community solar panel leases and stricter oversight of the solar industry, have advanced. Additionally, discussions continue about renewing school solar grant programs.

Though Senate Republicans present various proposals, Democratic leaders remain hopeful for collaboration in budget negotiations. Rep. Liz Fiedler stated ongoing talks suggest possibilities for integrating EDGE and solar legislation, underscoring the importance of maintaining open lines of communication as discussions progress.
