Federal Authorities Revoke Discrimination Lawsuit Against Sheetz

In a significant legal shift, federal authorities have moved to withdraw a racial discrimination lawsuit against the Sheetz convenience store chain. The Equal Employment Opportunity Commission (EEOC) initiated the motion in a Pennsylvania federal court, following President Donald Trump’s directive to deprioritize “disparate impact liability” in civil rights enforcement.

Disparate impact liability maintains that seemingly neutral policies can violate civil rights if they inadvertently disadvantage certain demographic groups. The EEOC’s lawsuit, originally filed under the Biden administration, alleged that Sheetz’s criminal background check policy unfairly discriminated against Black, Native American, and multiracial applicants. The EEOC reported that 14.5% of Black applicants were denied employment compared to 8% of white applicants.

Trump’s recent executive order characterizes disparate impact assessments as detrimental to a merit-based workforce and aims to minimize their application. This move is part of a broader campaign to reshape civil rights enforcement, including changes in agency priorities and the potential reduction of rights protections for marginalized groups.

Despite the EEOC’s motion to dismiss, the case may continue. A former Sheetz employee, Kenni Miller, who was fired due to his background check results, has filed a motion to intervene as a claimant. Legal experts anticipate thousands may join.

The retraction of federal enforcement actions against disparate impact has sparked concern among civil rights advocates, warning it may discourage companies from self-regulating their hiring practices. Former EEOC officials assert that the law remains intact, urging employers not to assume they will escape liability due to the administration’s new stance.

The ongoing developments highlight the tension between civil rights enforcement and administrative policy, shaping the future landscape of workplace equity in America.
