PA Hospitals Barred from Forcing Dismissed Doctors to Leave Patients behind


A new Pennsylvania law, the Fair Contracting for Health Care Practitioners Act, aims to protect continuity of care for patients by limiting the use of noncompete agreements for certain health care professionals. The law addresses the challenges faced by practitioners like Shyam Thakkar, a gastroenterologist who was unable to get another job in Western Pennsylvania due to a noncompete agreement after being dismissed from Allegheny Health Network.

The law makes noncompetes invalid if a doctor is dismissed and puts a time limit on the agreements. While it has been praised for leveling the playing field for clinicians, critics argue that it leaves out important health care workers and doesn’t address geographic restrictions in noncompetes.

Health systems argue that noncompetes help prevent bidding wars among specialists and ensure workforce stability, which is important for patient care. Critics, however, say that these agreements can hinder job competition and impact patient access to care.

The Fair Contracting for Health Care Practitioners Act has drawn mixed reactions from both supporters and critics. Some feel that the law could be strengthened to address the concerns raised, such as expanding its coverage to include a wider range of health care professionals and placing stricter limits on the geographic scope of noncompetes.

Lawmakers are set to review the legislation in the future to determine its effectiveness and impact on the healthcare industry. State Rep. Dan Frankel, who sponsored the bill, hopes to address some of the gaps in the law in future revisions based on the findings of the Pennsylvania Health Care Cost Containment Council.
