Ex-Officer Claims Felony Stop Was Overstated

Former Memphis police officer Emmitt Martin III testified in the federal trial of his three former colleagues accused of violating Tyre Nichols’ civil rights during a fatal traffic stop in 2023. Martin admitted that officers had exaggerated Nichols’ behavior and that he posed no threat during the stop that escalated into a violent beating. Three defendants in the case are charged with using excessive force, witness tampering, and conspiracy, while two others, including Martin, have already pleaded guilty to similar charges.

Martin’s testimony revealed that Nichols was not a threat and did not warrant the aggressive force used by the officers, which included pepper spray, a Taser, and physical violence. Nichols, who was Black, died three days after the incident, sparking national outrage and calls for police reform.

The testimony also exposed the SCORPION unit’s practice of exaggerating suspects’ actions to justify using force, with a focus on increasing felony arrests and confiscating guns, drugs, and money. Martin admitted that his return to duty after being hit by a car left him feeling angry and seeking revenge, contributing to the aggressive handling of Nichols.

Martin described how the “run tax” enforced by Memphis police involved beating individuals who attempted to flee from officers, even if they posed no immediate threat. He also detailed the enforcement of a policy requiring all officers to have hands on a suspect being handcuffed.

Overall, Martin’s testimony provided crucial insights into the events leading to Nichols’ death and highlighted the need for accountability and reform within law enforcement agencies.
